Welcome to vEcharz.com (“vEcharz”, “Platform”, “We”, “Us”, or “Our”). These Terms of Service (“Terms”) constitute a binding legal agreement between you (whether an EV Driver, a P2P Host, or a general site visitor) and vEcharz. By accessing or using our mobile-first progressive web application (PWA), website, route planning tools, or services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Platform.
1. Nature of the Platform (Intermediary Status)
- Decentralized Network: vEcharz operates strictly as a marketplace aggregator and technology intermediary under Section 79 of the Information Technology Act, 2000 (India).
- No Hardware Ownership: We do not own, operate, test, maintain, or manage any physical electric vehicle charging stations, electrical lines, or hardware infrastructure.
- Two Supply Tiers:
- P2P Host Network: Independent third-party property owners (such as dhabas, farmhouses, or residences) list their own hardware.
- Commercial Directory: Commercial Charge Point Operators (CPOs) mapped externally via public data or APIs. For commercial listings, vEcharz merely redirects you to maps or external endpoints; we accept no liability for their uptime, pricing, or hardware state.
2. Eligibility & Account Registration
- Eligibility: To register an account, make bookings, or list a property, you must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872.
- Account Responsibility: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and updated information at all times.
3. Special Provisions for P2P Hosts (Supply Side)
By onboarding your residential or commercial space (dhaba, farmhouse, property) as a Host on vEcharz, you explicitly warrant and agree to the following:
- Electricity & DISCOM Load Compliance: You must verify that your electrical infrastructure is legally and physically sound. If you advertise a 3-phase high-speed setup (11kW or 22kW), you must upload authentic electricity bills proving your Sanctioned Load with your local Distribution Company (DISCOM). Providing manipulated or false bill parameters constitutes fraud and will result in immediate termination.
- Domestic Tariff Slabs: Hosts recognize that charging residential/commercial EVs can push their consumption into higher progressive tariff billing slabs. The vEcharz Domestic Tariff Slab Safety Calculator is provided purely as an operational estimation tool. The final responsibility for paying your utility bill, tracking electricity tax brackets, and avoiding household breaker overloads lies strictly with you.
- Grid Offline Emergency Toggle: If your local grid experiences instability or if you must run heavy appliances that jeopardize safety, you are required to use the 1-Click Emergency Toggle in your dashboard. This pauses your listing for 2 hours and automatically pushes rerouting signals to incoming drivers via our Trip Planner. Failure to toggle offline during a power cutout which leaves a driver stranded may result in penalties or platform deactivation.
4. Special Provisions for EV Drivers (Demand Side)
- Data Certainty Disclaimer: While vEcharz implements verification layers (e.g., the “DISCOM Load Verified” badge), routing geometries and charging station statuses generated via our Trip Planner are dependent on data submitted by hosts and external mapping APIs. Real-time availability, charging speeds, grid voltage drops, and road accessibility along highway corridors may vary.
- Use at Own Risk: Drivers plug into Host chargers entirely at their own risk. It is the driver’s responsibility to check that the host’s cable, socket, and physical environment are safe and compatible with their electric vehicle before commencing a top-up.
5. Fees, Billing, and Payments
- Convenience Fees: vEcharz reserves the right to charge convenience or transaction fees for connecting drivers with peer-to-peer hosts. All applicable platform fees will be displayed prior to transaction confirmation.
- Taxes: Hosts are solely responsible for compliance with any local taxation laws, including local commercial activity regulations or Goods and Services Tax (GST) if applicable to their earnings.
6. Limitation of Liability & Indemnity
- Disclaimer of Warranties: To the fullest extent permitted by Indian law, vEcharz provides its platform on an “As-Is” and “As-Available” basis without warranties of any kind, whether express or implied.
- Exclusion of Damage: vEcharz shall NOT be liable for any direct, indirect, incidental, special, or consequential damages arising from:
- Vehicle battery damage, electrical fires, short circuits, or grid failures occurring at a Host’s property.
- Range anxiety consequences, towed vehicles, or stranded drivers caused by outdated directory data or unannounced host blackouts.
- Property damage or bodily injury occurring to either party during a physical charging session.
- Indemnity: You agree to indemnify, defend, and hold harmless vEcharz, its directors, employees, and affiliates from any third-party claims, liabilities, losses, or legal costs arising out of your breach of these Terms, misrepresentation of grid loads, or negligent behavior during a charging event.
7. Intellectual Property & Prohibited Activities
- Ownership: The text, code frameworks, SVG logos, brand designs, and proprietary geo-corridor matching algorithms remain the sole intellectual property of vEcharz.com.
- Scraping Prohibited: You may not use automated spiders, web scrapers, or reverse-engineering scripts to copy our aggregated database of P2P hosts, corridor polylines, or location layouts.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any legal dispute, arbitration claim, or litigation arising from your use of the platform shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
